There is more to a case than the belief that someone owes you money for damages. You must be able to prove certain things about the events that caused your accident, as well as the reality of the damages you sustained. Here are three aspects attorney Lundin touches upon:
1. Prove your damages. In order to receive compensation for injuries, you must be able to prove that the negligent or hostile actions of another individual led to your injuries. You must also prove that you will have real medical expenses (with the help of a doctor’s diagnosis).
2. Prove the fault of the other driver. To receive compensation for your injuries, you must be capable of proving that the other driver was at fault in the accident. Also, due to the fact that Maryland and DC practice contributory negligence, you must prove that the other party is 100% responsible for the accident. If you contributed to the accident, even in the most minor of ways, you are no longer entitled to compensation.
3. Prove coverage. You must do the research or consult with an attorney to determine which insurance policy covers your injuries. The wording can be difficult.
